What Is Title Insurance—and Why Every Homebuyer Should Care

When it comes to buying a home, most people focus on the down payment, mortgage rate, and monthly payments. But there’s one essential part of the transaction that often flies under the radar—title insurance. It might not be the flashiest topic in real estate, but it plays a crucial role in protecting both buyers and lenders from potentially devastating financial surprises.

As a local real estate professional, I always make it a point to educate my clients about title insurance so they understand how it fits into a smooth and secure home purchase. Here’s what every buyer (and seller) should know.


What Is Title Insurance?

Title insurance protects against future claims or legal disputes over the ownership of a property. Think of it as a one-time investment that acts like a safety net, shielding you from hidden issues in the property’s history—things like:

  • Unpaid liens or property taxes

  • Clerical errors in public records

  • Forged documents or fraud

  • Claims from unknown heirs of a previous owner

Even something as simple as a typo in a deed or an old unpaid contractor bill can delay or derail a sale—or cost you thousands down the road.

In fact, according to the American Land Title Association, even Abraham Lincoln’s family lost two homes because of title issues. It can happen to anyone.


Two Types of Title Insurance: Who It Protects

There are two primary kinds of title insurance:

🏦 Lender’s Title Insurance

This protects the bank or financial institution funding your mortgage. It’s usually required as part of your loan approval. It covers the loan amount—not your full investment—and remains in effect until the loan is paid off.

🏡 Owner’s Title Insurance

This is optional but highly recommended. It protects you, the homeowner, for as long as you own the property. If an issue pops up years after closing—say, a previously unknown heir claims they inherited the home—this policy helps cover your legal fees and financial loss.


How Much Does Title Insurance Cost?

Title insurance is a one-time fee typically paid at closing. Costs vary by state, but you can generally expect it to run about 0.42% of the home’s purchase price, according to Fannie Mae. On a $400,000 home, that’s about $1,680—an expense that may be rolled into your closing costs.

In some markets, it’s customary for the seller to cover the buyer’s title insurance, but this is negotiable.


What Does It Cover?

While policies vary, here are common scenarios where title insurance steps in:

  • Unpaid liens from previous owners

  • Boundary disputes with neighbors

  • Forged or fraudulent documents

  • Clerical errors in property records

  • Claims from unknown heirs

Bottom line: If a title issue arises, you’re not left alone to fight it. Title insurance pays for the legal defense and, if needed, financial reimbursement.


Common Misconceptions About Title Insurance

Let’s clear up a few myths I often hear:

  • “Title insurance isn’t necessary—my title search is clean.”
    Title searches are thorough but not foolproof. Title insurance protects against what can’t be seen or anticipated.

  • “It’s too expensive.”
    Compared to the financial loss you could face in a dispute, it’s a relatively small price to pay for peace of mind.

  • “It only protects the lender.”
    Not if you buy an owner’s policy—it protects you, too.

  • “New construction homes don’t need it.”
    Even brand-new homes can have title issues tied to the land or unpaid contractor liens.
